Five People Killed, Three Injured in Head-On Collision in Centerville, Arkansas
According to Arkansas Matters, 5 people were killed and 3 injured in a
car accident in Centerville, Arkansas. The incident occurred Sunday
afternoon, February 5 when Arkansas State Police believe 28-year-old
Joey Dean Striker Nichols crossed the center line of Highway 7 and
struck the vehicle of 56-year-old Clara Fay Meriweather head-on.
Meriweather was killed at the scene, while Nichols died a short while
later. Also killed were 24-year-old Jessica Nichols, 13-year-old Jessie
Meriweather, and 12-year-old Robert Meriweather. Injured in the accident
were passengers of Meriweather's vehicle, 9-year-old Jacob Meriweather,
12-year-old Jason Tyler Johnson, and 10-year-old Garrett Johnson.
Commentary First,
let me offer my condolences, and I hope the remaining injured victims
experience a full recovery. To begin to understand possible civil
remedies from the accident, a third party investigation must be
conducted. This investigation would inspect the accident scene as well
as both vehicles to determine liability and hopefully provide a cause
for the errant vehicle. If inattention or some other driver error were
found to be the cause of the straying vehicle, there could be standing
for a wrongful death claim, provided a few factors are present.
The first factor in deciding standing for a wrongful death
claim is a liable party, typically designated as such from a police
report. That party must then be deemed negligent, which is usually aided
by the efforts of the separate investigation, as the details of the
accident will factor into this determination. Beyond identifying a
liable party and negligence, a claim only has standing if the victim has
survivors who are eligible under state law to file on their behalf, and
these survivors must be able to show a loss of finances as a result of
the accident. A successful claim can compensate survivors in areas like
funeral costs, loss of consortium, or loss of financial support the
victim provided.
