Pedestrian Irene Bourgeois Killed by Hit-and-Run Driver in Houston, Texas
According to the Houston Chronicle, a woman was killed in a hit-and-run
accident in Houston, Texas. The incident occurred around 6:30 p.m.
Thursday, February 2 when Houston police believe the driver struck
78-year-old Irene Bourgeois while she was crossing South Mason Road. The
suspect then fled the scene in a Ford F150.
Update:
20-year-old Cory Christopher Bonnefin was arrested in connection with
the hit-and-run.
Commentary I am
typically very skeptical of hit-and-run drivers for a number of reasons.
Not only do they usually have a reason for running, but they also taint
or destroy evidence which could aid a victim or their survivors in
seeking compensation. The preservation of evidence is particularly
relevant to a victim, as the plaintiff will always bear the burden of
proof. For this reason, an independent investigation should be used for
liability purposes, as the police reports in the matter may only
indicate fault. To have standing in a wrongful death claim, a
party must be deemed liable. Then, their actions must be viewed as
negligent. Essentially, this means that a party has let their actions at
the time of the accident fall below what a reasonably prudent person
may expect. After negligence is found, a claim must have survivors who
are eligible under Texas law to bring a claim, and they must be able to
show a tangible financial loss from the accident.
