Tameca Trueblood Killed in Rollover Accident in Belton, Texas
According to KXXV, a woman was killed in a rollover accident in Belton
near Waco, Texas. The accident occurred around 4:50 a.m. Wednesday,
January 25 when a Chrysler minivan veered off the roadway, struck a
tree, and then rolled over. 33-year-old Tameca Trueblood was a passenger
in the vehicle, and was pronounced dead at the scene. Belton police
continue to investigate the accident.
Commentary Anytime
an accident is reportedly caused by an errant vehicle, a third party
should be tasked with inspecting the car in question and the driver's
actions prior to the accident. The former could uncover a defect in the
vehicle, such that a third party manufacturer may be liable. The latter
would need to determine if the driver's actions presented a danger to
themselves and their passengers, potentially opening themselves for
liability as well. This liability could translate to a wrongful death
lawsuit if a few parameters are present. To have standing in a
wrongful death suit, a claim must first have a liable party. From
there, the liable party's actions must be deemed negligent, in other
words falling below what is reasonable at the time of the accident. It
should be apparent that a negligence finding is incredibly dependent
upon facts and evidence of the incident, such that a separate
investigation is imperative. After negligence, a claim only needs
survivors who are eligible under Texas law to file on behalf of the
victim, and they must be able to prove an actual financial loss from the
accident.
