Motorcyclist Armando Aleman Killed in Accident with SUV in Seguin, Texas
According to the San Antonio Express-News, a motorcyclist was killed in an accident with an elderly driver in Seguin, Texas. The accident occurred Friday afternoon, January 20 when 59-year-old Armando Aleman was riding his motorcycle south on North Austin Street. A 93-year-old driver traveling the opposite way swerved to avoiding striking two cars and struck Aleman head-on. He was taken to San Antonio Military Medical Center where he later passed away. The elderly driver was issued a citation for failure to control speed.
Commentary Elderly or not, failing to control one's speed on the roadway is a serious problem. This bit of information from the police reports, coupled with the use of an independent investigation to shore up liability, could develop strategies for survivors of the victim. Typically, a police report placing fault on a driver is not enough to be successful in civil court. That is why evidence is gathered, depositions are taken, vehicles are inspected, and accident scenes are examined, in an effort to accurately reflect liability. To have standing in a wrongful death claim, a plaintiff (survivors of the victim) is tasked with proving that a liable party was negligent at the time of the accident. Again, this is heavily dependent upon police reports and the findings from the investigation. If a vehicle's speed was not controlled, this could reach the threshold of negligence, as this may be outside the boundaries of what a prudent person would expect. Once negligence is established, the claim only needs eligible survivors who can prove an economic loss from the accident.
