Passenger Jasmine Smith Killed in Street Racing Accident in Little Rock, Arkansas
According to Arkansas Matters, two people were killed in a car accident in Little Rock, Texas. The incident occurred Tuesday afternoon, January 24 when police believe 33-year-old Kenyata Lake was racing another vehicle on South University. Lake clipped the vehicle of another car which crashed with a school bus. Lake's vehicle continued southbound and collided with another vehicle, then striking a pole. Both lake and his passenger, 22-year-old Jasmine Smith were killed in the accident. No other injuries were reported.
Commentary Street racing is not only illegal, it is incredibly dangerous. Yet, when a passenger is involved, it makes the action that much worse. If the police reports are accurate and the driver was racing a vehicle in the city, there could be potential remedies available for the survivors of the passenger. These are only extolled, however, through the employ of a third party investigation that can work in collaboration with the police reports. In the event of a fatal accident, the usual remedy is a wrongful death claim, provided that certain variables are present. Certainly there must be a liable party from the accident, but more importantly, their actions must be deemed negligent. Again, if the police reports are accurate and street racing occurred, this could reach the threshold of negligence, which is typically measured by a defendant's actions falling below what a reasonably prudent person would expect. If this is found, the next variable needed are eligible survivors under Arkansas law who can file a claim on behalf of the victim, and they must be able to prove a loss of finances as a result of the accident. If successful, damages like funeral arrangements, pain and suffering, and loss of consortium could be available for compensation.
I wanted to update my post to reflect the news reports that the woman killed in the accident was pregnant. I just do not understand the reckless behavior with a pregnant passenger on board. It is frustrating, to say the least.
