Kaylin Pearson and Kerniece Jonf Killed in Car Accident in Amarillo, Texas
According to KTXS, two teenagers were killed in a traffic accident in
Amarillo, Texas. The accident occurred early Sunday, January 22 when
Amarillo police believe 19-year-old Kaylin Pearson was turning left onto
North Florida Street when she was struck on the passenger side of her
vehicle by an SUV. Pearson and 19-year-old Kerniece Jonf were killed in
the accident.
Commentary The news
feed does not give much in the way of details, but I can unequivocally
say this is a tragedy. Liability really cannot be determined by the
statement that a vehicle made a left turn and was struck. An
investigation should then be used in corroboration with the police
reports to make a fault determination. This could lead to potential
remedies from the accident, given certain variables are met.
To have standing for a wrongful death claim, a party must
first be identified as liable. From there, the liable party's actions
must be deemed negligent. This is where the value of the separate
investigation is extolled, as liability is always an issue that is
banded about by defense attorneys and adjusters. After negligence, a
claim needs survivors who are eligible under Texas law to file on behalf
of the victim and lastly they must be able to show a loss of finances
due to the accident.
