Dakota Shane Sabin and Billy Gene Barrett Killed in One-Car Accident near Pleasanton, Texas
According to several news sources, two oilfield workers were killed and
one injured in a one-car wreck along Interstate 37 near Pleasanton,
Texas. The accident occurred around midnight Monday, January 16 when
Texas DPS officials believe 36-year-old Shawn Patrick Nichols veered off
the roadway and struck a center median, overturning his pickup.
33-year-old Dakota Shane Sabin and 29-year-old Billy Gene Barrett were
killed in the accident. Nichols was taken to South Texas Regional
Medical Center where his condition was unknown.
Commentary The
increase in shale production down south means more workers traveling
into the area from all around the country, but it does not have to mean
more accidents. More than likely, there are two possible outcomes from
this accident, which means that a third party should attempt to uncover
the relevant route for restitution. If the three men were
acting within the course and scope of their employment, there may only
be an administrative claim with their employer's workers' compensation
policy. I know the midnight timing makes this possibility unlikely, but,
if the men were sent south by their employer from Arkansas, this could
fall within active employment. The third party investigation mentioned
above would be tasked with determining their status, so rightful
compensation can be sought. Conversely, if the men were not acting
within their employment, it is possible that a wrongful death claim
could be brought against the driver of the truck if certain variables
are met, namely negligence. Without knowing the details of the accident,
or the workers' employment statuses, it would be speculatory to assert
which scenario could apply.
