Terry L. Fisk Jr. Killed in Motorcycle Accident in North Little Rock, Arkansas
According to Arkansas Matters, a man was killed in an SUV-motorcycle
accident in North Little Rock, Arkansas. The incident occurred around 6
p.m. Tuesday, January 17 when a motorcycle and SUV collided at the
intersection of 46th Street and Freda Road. The accident reports notes
the driver of the SUV did not see 32-year-old Terry L. Fisk Jr. on his
motorcycle. Fisk Jr. was pronounced dead at the scene.
Commentary While
not an admission of guilt, "not seeing" a driver could be an indication
of driver inattentiveness. This is speculation however, and would only
be determined following a third party investigation into the accident.
The investigation would be tasked with recreating the accident scene as
well as inspecting both vehicles and making a liability determination.
Given the results, a wrongful death claim could be appropriate with the
proper findings. A claim has standing if a party is determined
liable in an accident. Following this, the liable party's actions must
be ruled negligent. Negligence is a failure in care that a reasonable
person may expect. In regards to auto accidents, this care is usually
manifested in safe operation of a vehicle, especially when other
motorists are within close proximity. After negligence is determined, a
claim only needs to be brought by survivors of the victim, but it should
be noted each state has their own guidelines as to who is eligible to
bring a claim on the victim's behalf. Furthermore, these eligible
survivors must be able to show an actual loss of financial resources due
to the accident.
