Luis Bernal Killed in an 18-Wheeler Accident in Ector County, west of Odessa, Texas
According to NewsWest 9, a man was killed in a
collision with an 18-wheeler in Odessa, Texas. The accident occurred
around 6:45 a.m. Friday, January 13 when police believe 20-year-old
Luis Bernal lost control of his vehicle on Interstate 20, swerving
into oncoming traffic and was then struck by an 18-wheeler. The driver
of the rig tried to avoid the vehicle but clipped a tanker truck.
Bernal was pronounced dead at the scene, while the two truck drivers
were uninjured.
Commentary Any time
a driver is said to have lost control of a vehicle, causing an
accident, an inspection of the vehicle should be conducted. Then, the
actions of the truck driver should be crosschecked with the training a
commercial hauler receives regarding evasive actions. Is it possible
that the effects of the accident could have been lessened had other
actions been taken? Possibly. This type of information is only extolled
through the use of a third party investigation. We often
find accidents where cause is clearly placed on one driver, but the
actions or lack of action of another played a role in the outcome. In
situations like these, juries are tasked with deciding just how big of
a role each action did indeed play in the incident. The endgame is
not to blame every party for an accident, but rather accurately
determine relevant contributing
factors.
