Johnny Mendez, Jennette Garcia Killed in Accident with Suspected Drunk Driver in San Antonio, Texas
According to the San Antonio Express-News, two people were killed and
two others injured in a collision with a suspected drunk driver in San
Antonio, Texas. The accident happened around 3:20 p.m. Thursday, January
5 when police believe 49-year-old Rogelio Rincon overcorrected in a
turn and struck a vehicle traveling the opposite direction head-on.
Killed in the accident was the driver of the other vehicle, 74-year-old
Johnny Mendez and a passenger in Rincon's vehicle, 37-year-old Jennette
Garcia. Two other passengers, one in each vehicle, were also injured and
taken to University Hospital. Police said they found beer cans in
Rincon's vehicle.
Commentary Drunken
driving is a particular problem for our state. Though legislators have
attempted to strengthen laws against the act, the problems remain. It
should be noted however, that until blood-alcohol levels are published,
these are only allegations. Regarding the actual accident, an
independent investigation should be used in addition to the police
reports for liability purposes. These investigations are used to develop
strategies regarding civil remedies available following an accident.
When an accident results in a fatality, civilly the outcome is
usually a wrongful death claim. This claim is contingent on a number of
factors, but most importantly, a determination of negligence.
Negligence is produced when a liable party's actions fall below what a
reasonable person would have expected at the time of the accident. This
is typically decided by a jury of one's peers, rather than any single
entity. However, if the alcohol allegations are true, that could shift
greater responsibility onto the drunken driver. If a wrongful death
claim is successful, it could allow for the collection of damages like
medical bills prior to death, lost wages, funeral costs, or loss of
monetary support the victim provided.
