Kaat Debeuckalaer, Kenneth Lark and Ronald Eddins Killed in One-Car Accident in Dallas, Texas
According to several local news sources, three people were killed in a
single-vehicle accident in Dallas, Texas. The accident occurred early
Wednesday morning, January 4 when police discovered a Porsche submerged
in the Las Colinas Canal. Police believe the driver of the Porsche,
41-year-old Ronald Eddins, lost control and crashed into the canal.
Eddins, along with 21-year-old Kaat Debeuckelaer and 23-year-old Kenneth
Lark were killed in the accident. Excessive speed is thought to be a
factor in the accident. Police continue to investigate the
accident.
Commentary This is a
very unfortunate accident and just proves that excessive speed, if
indeed that was a factor in the accident, is not needed anywhere on the
road. The police will continue to investigate the accident, but in my
experience handling fatal automobile crashes, a third party
investigation should be used for liability purposes, especially since
some news reports have mentioned a bar was visited before the accident.
Following the results of both investigations, the most likely
outcome could be a wrongful death claim, but certain factors must be
met. Namely, a party must be found liable in the accident. Then,
probably the most important factor towards standing in a claim is a
determination of negligence. Legally speaking, negligence occurs when a
party's actions fall below what a reasonable person could expect at the
time of the accident. In regards to this particular incident, this
threshold may be met by confirming the use of excessive speed. Following
negligence, a claim need only eligible survivors (eligibility comes
from Texas law) who can legally file a claim on the victim's behalf.
Further, these survivors must be able to prove a loss of economic
faculties from the accident. Regarding the bar which has been
mentioned in several reports, if alcohol is also found to be a factor in
the accident, the investigation would be tasked with researching the
levels of intake by patrons prior to leaving. But for now, any
discussion of including other parties to a civil claim are premature and
promote unnecessary speculation.
