Elias Silva-Gonzales Killed in Accident with Vehicles Racing in Dallas, Texas
According to KDFW, a man was killed when he was struck by a vehicle that
police believe was racing another vehicle in Dallas, Texas. The
accident occurred Sunday, January 1 when 43-year-old Elias
Silva-Gonzales was attempting to turn onto Westmoreland Road when his
vehicle was struck by a Suburban that police believe was speeding.
Silva-Gonzales was taken to a local hospital where he later passed away
Sunday afternoon. The driver of the SUV was also taken to a hospital but
not seriously injured. Dallas police have not caught the driver of the
other vehicle involved in the street racing.
Commentary This is a
terrible accident and all at the expense of street racing. Very
frustrating to say the least. Because such serious injuries were
inflicted from this incident, an independent investigation should be
used to corroborate the police reports and establish a concrete theory
of liability. This will go far in establishing potential strategies
resulting from the accident. One of the most apparent effects
from the incident could be a wrongful death claim, provided certain
elements are present. To have standing, first and foremost a party must
be identified as liable. From there, and probably most importantly to
securing compensation, a negligence determination must be made. If the
reports are accurate and the driver of the other vehicle was street
racing, this could meet the threshold of negligence, which is based on a
reasonableness test. If negligence is met, a claim only needs survivors
of the victim who are eligible to file on behalf of the victim and they
must be able to show a loss of financial faculties from the accident.
