Micheal West and Suzan Fincher Killed in Auto Accident in Alba-Golden, Texas
According to KYTX, two people were killed and two left in critical
condition following an accident on Highway 69 near Golden, Texas. The
wreck occurred Tuesday morning, December 27 when Texas Department of
Public Safety officials believe a white truck rear-ended a Honda,
sending the vehicle into oncoming traffic. The Honda was then struck on
the side by a Camry and bifurcated in the impact. Killed in the accident
were 38-year-old Micheal West and 74-year-old Suzan Fincher.
69-year-old Margaret Miller and 74-year-old Angela Shoffstall were taken
to ETMC where their conditions are unknown.
Commentary My
thoughts are with the victims, and I hope those who made it through the
accident experience a full recovery. Because multiple vehicles and
parties are involved, a third party investigation should be used to
recreate the accident scene as well as inspect all vehicles for a
liability determination. The news feed seems to identify only one party
as incurring any fault, but rarely is that the case in a multi-vehicle
accident. You see, liability is an entity that typically spreads between
more than one party, due to their actions at the time of the accident.
This is important because a proper determination goes a long
way in extolling the appropriate civil remedy available to a victim or
their survivors. In an accident like this, a wrongful death claim could
be appropriate, given the correct circumstances. For standing
in a wrongful death claim, a party must be identified as liable in the
accident. Then, there must be a negligence assessment based on the
actions or inaction of the liable party. Once that is concluded, a claim
needs survivors who are eligible under state law to bring a claim on
the victim's behalf and they must be able to show a court some type of
tangible economic loss from the accident.
