One Killed, One Injured in Two-Car Accident on Loop 20 in San Antonio, Texas
According to Pro 8 News, one man was killed and a passenger critically injured in a two-vehicle accident in San Antonio, Texas. The wreck occurred around 9:30 p.m. Wednesday, December 28 when police believe the male driver lost control of his vehicle on Loop 20 and swerved into oncoming traffic. His vehicle struck the car of a female and child, but both sustained only minor injuries. A passenger in the unidentified male's car was airlifted to a local San Antonio hospital.
Commentary I hope all the parties injured in the accident experience a full recovery and my condolences go out to the family of the deceased. When a news story suggests that a driver inadvertently lost control of their vehicle, an inspection of the vehicle and the accident scene should take place for liability purposes. Following the investigation, there are two possible claims for compensation from the accident. Most realize that a personal injury claim could be filed against the insurance of the liable party, assuming the details of the news story are accurate. To be successful in a motion like this, a plaintiff must prove that a liable party owed them a legal duty (in this matter safe vehicular operation) and breached that duty. But perhaps the less obvious claim is one against a manufacturer, if a defect were to be found on either vehicle, such that it contributed to the accident. I realize the immediate question many may have is how does the other car play a role in this determination. Well, imagine a scenario where a driver views an out of control vehicle coming at them and applies the brakes, only for them to give out due to the rapid depression. Though the driver certainly did not cause the accident, their vehicle may have contributed. Perhaps far-fetched to some, but no stone in a fatal car accident should be left unturned.
