Four Women Killed in Accident with Suspected Drunk Driver in Memphis, Tennessee
According to local news sources, four women were killed in an accident
with a suspected drunk driver in Memphis, Tennessee. The incident
occurred around 6:30 p.m. Saturday, December 24 when Shelby County
Sheriff's Officers believe 38-year-old Lenard Robinson Jr. rear-ended a
Chevy Impala on Raleigh-Millington Road. The impact caused the Impala to
swerve into oncoming traffic and was then struck by another vehicle.
Four women were killed in the Impala, including 47-year-old Tarla
Fisher, 44-year-old Shirley Watkins, 26-year-old Chrystal Hill, and
42-year-old Marjorie Tucker. Robinson has been charged with four counts
of vehicular homicide, driving under the influence, reckless driving,
speeding and two counts of felony reckless endangerment.
Commentary This is
an incredibly unfortunate accident which, just like many other suspected
drunken driving accidents, could have been prevented. These are
frustrating events to be sure. An independent investigation should be
used for accident recreation to produce concrete liability. If the
police confirm the alcohol allegations, not only will this factor into
the liability determination, but could also produce a liable third party
in the accident. Most realize that if a party negligently
contributed to a fatal accident, a wrongful death claim could be pursued
given the right circumstances. Others may not realize the potentially
liable third party I mentioned. Although limited, Tennessee has liquor
liability laws that apply to adults (as well as the more well-known laws
punishing service to minors). These laws, called dram shop laws, allow
for a bar or restaurant to incur limited liability if they were found to
serve an obviously intoxicated patron. Certainly a few details would
need to be extolled by the investigation for this to take place. For
instance, the investigators would be tasked with tracing the alleged
drunk drivers steps before the accident and would then need to prove
that the place of business abused their liquor license. This abuse is
sadly manifested in several ways, but relevant to this accident is the
service of drinks to a person that a server/waiter/bartender should be
able to identify as intoxicated. Though only limited liability
is incurred, the hope is the entity changes their ways to provide safe
and legal service of alcohol to patrons and possibly prevents a future
accident.
