Ethel Hazet Killed in One-Vehicle Crash in Dallas, Texas
According to Fox 4, a woman was killed and a man injured in a
one-vehicle wreck in Dallas, Texas. The accident occurred around 11:30
p.m. Monday, December 26 when Dallas police discovered the SUV of
58-year-old Ethel Hazet flipped upside-down on Loop 12. Police believe
alcohol was involved. Hazet was taken to Parkland hospital
where she later passed away. A passenger in the vehicle was also found
and taken to Parkland, where he was said to be in stable condition. The
investigation into the accident continues.
Commentary Some
reports have suggested that police have yet to determine who was driving
the vehicle, and the possibility of alcohol being a factor in the
accident has yet to be determined. Either scenario makes this accident
one that needs the aid of a third party investigation, as a liability
determination may be very difficult to make initially. Depending on who
was driving, that person could be subject to a personal injury or
wrongful death claim, depending on relevant circumstances. It
should also be noted that if an alcohol link is determined by the
police, a separate investigation is even more crucial, as a liable third
party may be identified. This would require tracing the steps of the
intoxicated driver to prior to the accident and identifying where the
alcohol was consumed. If a bar or restaurant was found to continue to
serve an obviously intoxicated patron, there is a chance that entity
could be held partially liable in the accident. When a person
is "obviously intoxicated" (the legal standard for these "dram shop"
laws to take effect), they present a clear danger to themselves and
others. To legally commercially serve alcohol, our state requires bars
and restaurants to undergo training to be able to identify this level of
intoxication, and subsequently stop service. When they fail to do so,
case law and TABC guidelines could make them partially at fault (not
fully at fault, as no bar or restaurant employee was operating the
vehicle).
