Raymond Murski Killed, Norman Wallace Injured in Car Accident in Burnet, Texas
According to KXAN, one man was killed and another injured in a car
accident in Burnet, Texas. The accident occurred around 2 p.m. Monday,
December 19 when Burnet police believe 72-year-old Raymond Murski
drifted into oncoming traffic on Highway 281. Murski's vehicle struck
the vehicle of 42-year-old Norman Wallace head on. Both men were taken
to Austin hospitals where Murski was later pronounced dead, while
Wallace is in stable condition. Burnet police continue to investigate
the accident.
Commentary Fault in
a news story is certainly not enough to obtain restitution in a civil
matter. A third party investigation should be used to determine
conclusive liability, which could help in providing strategies for
compensation moving forward. If the reports are accurate and the man
drifted into oncoming traffic, there could be standing for a wrongful
death claim, provided a few elements are met. For a wrongful
death claim to proceed, a party must first be identified as liable. The
liable party must then be determined negligent at the time of the
accident. This essentially means that the party's actions fell below
what would constitute as reasonable. Shifting a vehicle into oncoming
traffic could meet this threshold. From there, a claim only needs
survivors who are eligible under Texas state laws to file on behalf of
the victim, and these survivors must be able to show a loss of economic
faculties as a result of the accident.
