Motorcyclist Danny Ray Viola Killed in Accident with Suspected Drunk Driver in Dallas, Texas
According to the Dallas Morning News, a motorcyclist was killed in an
accident with a suspected drunk driver in Dallas, Texas. The accident
occurred around 12:40 a.m. Saturday, December 17 when 56-year-old Danny
Ray Viola was struck on Preston Road by 18-year-old Joshua Reyes. Viola
was taken to Parkland Memorial Hospital where he was later pronounced
dead. Reyes has been charged with intoxication manslaughter from the
accident.
Commentary This is a
tragic situation for both the victim and the teenager. My thoughts are
with both families. Rather than discuss the ramifications of a wrongful
death claim, I'd like to discuss the potential contingencies if the
teenager is indeed found intoxicated, but not from his standpoint.
Again, these are only allegations at this point, but if the
alcohol link is established, there could be other parties at fault in
the accident. Though quirky, the state of Texas has laws in place that
could fault a home or property owner if minors are found to become
intoxicated on their premises and then involved in an accident. I
mention their quirks because they only apply to minors who are 18 or
younger. 19 and older and these social host laws, they are called, do
not apply. Adults who host minors have a responsibility to those minors,
and the service or acquiescence of alcohol breaches this
responsibility, which could shift some liability to the adult.
