Najee Nasir Killed in Accident with Alleged Intoxicated Driver in Arlington, Texas
According to several local news sources, a man was killed and another
shot following a car accident in Arlington, Texas. The accident occurred
around 1:40 p.m. when 42-year-old Najee Nasir was struck from behind by
the errant vehicle of Thomas Lester Harper. Harper then allegedly
randomly fired a gun at onlookers, killing another man. In Harper's
vehicle, two young twin children were found injured, but not
life-threatening. Officers believe the driver was intoxicated on a
substance other than alcohol. The Arlington police continue the
investigation.
Commentary What an
unbelievable, inexcusable, and completely unnecessary tragedy.
Unfortunately, personal injury law produces several terrible accidents,
but this incident is particularly frustrating. Luckily the authorities
believe the two young children will be fine. Because of the chaotic and
excessive nature of the accident, a third party should examine the scene
for recreation purposes and to identify potential civil remedies
available. The intoxication and murder charges will be handled
on the criminal side of the law, by the proper authorities. The fatal
car accident could produce a wrongful death claim against the driver of
the SUV. For a claim of this nature, a plaintiff is tasked with
identifying a liable party (probably not too difficult). Then, a
claimant must show that the party was negligent in their actions at the
time of the accident. If the reports are accurate and the man was
driving erratically and using excessive speed, this could certainly meet
this threshold. From there, a claim needs survivors who are eligible
under Texas state law to file on behalf of the victim, and they need to
be able to show a court of law that they have incurred financial losses
as a result of the accident.
