Luis Turcios Killed in Accident with Alleged Drunk Driver in Houston, Texas
According to the Houston Chronicle, a man was killed by a suspected
drunk driver while trying to aide car accident victims. The accident
occurred December 3 when Luis Turcios was helping at an accident scene
and was struck by the pickup truck of 62-year-old Lydia Martinez Mejia.
Mejia also struck a body belonging to the initial car accident and
swiped a wrecker at the scene. She has been charged with felony
intoxicated manslaughter.
Commentary This is
an especially frustrating accident, as it was entirely preventable.
Around an accident scene, particular care and attention is needed by
drivers. It would appear the victim was not afforded that level of care
by this driver. When an accident occurs, due in part, to the allegations
of drunken driving, a third party investigation should be used to
examine all possible civil remedies available. With the confirmation of
the alcohol link, there could be more possibilities. Most of
my readers will be at least somewhat familiar with the notion of a
wrongful death claim. When a liable party has negligently contributed to
another party's death, there could be standing for a wrongful death
lawsuit. However, it should be noted that if the allegations the driver
was intoxicated at the time of the accident are true, there could be
another party who is culpable for the accident. The aforementioned
investigation would be tasked with tracing the steps of the intoxicated
driver prior to the accident. If a bar or restaurant was found to be in
their close past, that entity may assume some liability in the accident
if certain variables are met. In the state of Texas it is certainly not
illegal to serve an adult alcohol, and not illegal to serve an adult to
the point of intoxication. However, when a patron becomes "obviously
intoxicated" (the legal standard for liquor liability) such that they
present a danger to themselves and others, service does become illegal.
This act could partially fault a bar or restaurant (I say partially
because they will never be held fully accountable as the bar was not
operating the vehicle). Including a bar or restaurant in a
claim is not an arbitrary matter and can produce tangible results if
successful. Inclusion could further compensate the loss of a loved one,
but perhaps more importantly, the bar is put on notice that their
business practices are not only illegal, but incredibly
dangerous.
