Lisa Stewart Wilmoth Killed in Single-Vehicle Accident in Conroe, Texas
According to local news reports, a woman was killed in a single-vehicle
accident in Conroe, Texas. The incident occurred around 9 a.m. Monday,
December 12 when Texas Department of Public Safety officials believe
49-year-old Lisa Stewart Wilmoth unexpectedly left the road way and
struck a fence. She was pronounced dead at the scene.
Commentary The
report notes no witnesses and unknown reasons for the accident. In an
incident like this where very few details are present, a separate
investigation is absolutely critical in determining liability. Scene
recreation is vital in understanding why a relatively new vehicle (as
pictured) left the roadway. The indication is that the vehicle
pulled from the roadway, then striking the nearby fence. It would be
prudent, then, to check the integrity of the braking system on the
vehicle. This may be an obvious statement, but product defects are only
apparent after their effects have been extolled. We have litigated
several accidents in the past that most blamed exclusively on driver
error, only to find a key system had failed prior to impact. Typically,
these are not the types of contingencies a police report will address,
and really highlights why a third party should examine the
accident.
