Woman Killed at Bus Stop by Truck that Allegedly Ran Red Light in San Antonio, Texas
According to local news reports, a woman was killed by an errant vehicle
while she waited at a bus stop in San Antonio, Texas. The accident
happened around 5:50 a.m. Monday, December 12 when police believe the
driver of the errant pickup truck ran a red light and struck another
vehicle, then careened into the woman at the stop. She became pinned
beneath the truck and later passed away from her injuries.
Commentary What a
terrible and unexpected tragedy. It is a shame something like this
happens to a victim just waiting for the bus. Because of the unexpected
and catastrophic nature of the accident, a third party investigation
should be conducted to shore up a liability determination.
With the allegations of a driver running a red light and then
striking another vehicle, there may be enough evidence to make a
negligence claim against that party. Even with favorable evidence, this
is not a position to be taken lightly. That is because negligence is
probably the single biggest hurdle to overcome for a victim (in a
personal injury claim) or their survivors to have standing for a
wrongful death claim. Once a liable party have been deemed negligent,
most of the legwork has been taken care of in a claim, with only a few
issues remaining. The claim must be filed by survivors of the victim,
who are eligible under Texas state law to pursue the claim and they must
be able to show actual loss of economic faculties as a result of the
accident. A successful claim can allow for compensation in
areas like funeral bills, medical bills incurred before death, or loss
of economic support the victim provided, to name a few.
