Man Killed Crossing Street in north Austin, Texas
According to KXAN, a man was killed while crossing Dessau Road when he
was struck by a car in north Austin, Texas. The accident occurred around
6:42 a.m. Monday, December 12 when the man was walking south along the
road. The driver of the vehicle stopped and provided assistance to
police.
Commentary When an
accident occurs where the facts are not clear, a third party
investigation should be used for scene recreation. The police reports
will go a long way in providing the details related to what actually
occurred, but the investigation should be used for liability purposes.
The investigation would look into issues like pedestrian
location relative to the roadway, driver behavior prior to the accident,
and the general hazard of the area in question. I mention the latter to
again highlight a concept I speak often about. Liability is rarely an
all-or-nothing determination. In other words, juries will often find
multiple parties liable in an accident. If the roadway was such that
existing hazards forced the man into danger, it is possible the city
could be partially liable as well as both parties involved. Certainly
this is more for example purposes and would need to be corroborated by
the findings of the investigation, but should show that every fatal
accident needs to be privately looked at, in order to extol any possible
civil remedies.
