Frances Lee, Brandi Brumley, Brayon Atkinson Killed in Head-On Accident in Centerton, Arkansas
Local news reports indicate three people were killed in a head-on collision near Centerton, Arkansas. The accident occurred around 1:15 p.m. Friday, December 9 when Arkansas State Police believe two SUVs were negotiating a curve headed opposite directions. One SUV, driven by Brandi Brumley, crossed the centerline of Highway 102 and struck the other vehicle, driven by Frances Lee. Three people were killed in the accident, including both drivers and Brumley's passenger Brayon Atkinson. A 3-year-old boy was also injured in Brumley's vehicle and was taken to a hospital in Little Rock, where his condition was unknown.
Commentary This is an incredibly tragic accident. I hope the young child experiences a full and quick recovery. When an incident of this magnitude occurs, an independent investigation should be used for scene recreation. With the damages being so great, a concrete liability determination is absolutely necessary if proper compensation is sought. One of the most common remedies available following a fatality, is a wrongful death lawsuit. To have standing for this type of suit, a few key legal elements must be met, of which if any are not present there normally can be no lawsuit. First, a party must be found liable in an accident. Then, their actions or inaction prior to the collision must be deemed negligent. Typically, this means the party's actions fall below what would constitute as reasonable. Examples of this could be driving with excessive speed or erratic driving. From there, a suit or claim must be filed by survivors who are eligible under Arkansas law (different states do actually have different requirements as to who can file a lawsuit on a victim's behalf). Finally, these survivors must be able to show a court that they have incurred some tangible financial loss as a result of the accident.
