Christina Flores Killed in Wrong-Way Accident with Suspected Drunk Driver in San Antonio, Texas
According to the San Antonio Express-News, a woman was killed in an accident with a wrong-way driver in San Antonio, Texas. The wreck occurred around 4:18 a.m. Saturday, December 10 when the woman's vehicle was struck by the wrong-way driver on Interstate 37. Police note the passenger in the struck vehicle was not injured. They believe alcohol was a factor in the accident.
Update: The female motorist has been identified as 43-year-old Christina Flores.
Commentary While I do understand that some of our roadways are complex systems, in most wrong-way accidents you probably have to start with alcohol as a factor. Once the police reports confirm or deny the alcohol link, a third party investigation should then be used to provide for civil strategies moving forward. As you might suspect, if the wrong-way driver was indeed found to be intoxicated at the time of the accident, that changes the scenario for possible remedies. Most realize the concept of a wrongful death lawsuit. If another party negligently contributed to another party's death, that liable party may be held accountable. In this post, I'd like to talk about the possible remedies available if the alcohol allegations are found true. Once they are conclusively proven, the third party investigation would then trace the driver's steps before the accident. If a bar or restaurant was found to serve the driver after they were "obviously intoxicated," there is a possibility they could be held vicariously liable for the accident. "Obviously intoxicated" is the standard that the state of Texas requires to be met if a bar or restaurant is to be found liable. This standard is precisely what the TABC trains servers and bartenders to recognize and subsequently stop service. It should be noted, however, that an alcohol-serving entity will never be held fully liable in a drunk driving accident, because at the end of the day they were not the ones operating the vehicle.
