Pedestrian Mary Christine Estrello Killed Crossing Street in San Antonio, Texas
According to the San Antonio Express-News, a woman was killed crossing
the street in San Antonio, Texas. The accident occurred around 7:10 a.m.
Wednesday, December 7 when 64-year-old Mary Christine Estrello was
crossing East Southcross Boulevard when she was struck by a pickup. The
driver told police he did not see Estrello due to ice on his windshield.
No charges were expected to be filed against the driver.
Commentary What a
terrible reason to give for an accident. Some cities actually issue
tickets to drivers operating a vehicle with ice or frost on their
windshield. In a pedestrian accident, a third party investigation should
be used to determine the contingencies associated with the event.
Issues like relative position of the pedestrian to the roadway, or speed
of the driver play roles in determining liability, which is then used
to develop civil strategies moving forward. Though the article
states no charges are expected to be filed, that does not rule out the
possibility of a civil cause of action against the driver of the
vehicle. To have a cause of action for, in this matter, a wrongful death
lawsuit, a few key elements must be met. First a party must be liable
in the accident. Next, their actions or inaction prior to the accident
must be found negligent and to have contributed to the accident. A claim
on behalf of the victim must have eligible survivors (according to the
laws of Texas) that can prove a tangible economic loss from the
accident.
