Joseph David Winsett Killed in Single-Vehicle Accident in Huffman, Texas
According to the Houston Chronicle, a man was killed in a single-vehicle
accident in Huffman, Texas. The incident occurred sometime before 4
a.m. Monday, December 5 when the vehicle of Joseph David Winsett drove
through a ditch and struck a culvert. Harris County Deputies note the
victim died at the scene. There were no witnesses to the crash.
Commentary Having
been in this business for over two decades now, I'm aware of the
conclusions people will arrive at when they read the news feed. I can
say however, that many of the one-car accidents we have litigated in the
past actually revealed another issue rather than driver error.
Especially when an accident has no witnesses, a meticulous
investigation, aside from the police reports, should be used for
liability purposes. The investigation should check the
integrity of the vehicle for any manufacturing defects or flaws. We
litigated an accident with a similar fact pattern that found a vehicle
with defective brakes. The driver of that vehicle tried to apply the
brakes around a turn and lost control. A scenario like this could point
fault at two possible parties. First, a company that services the system
could be faulted if they failed to properly repair the system.
Conversely, if the system was defective from the onset, a manufacturer
could assume some liability. Either scenario really points towards to
the efficacy of the investigation in revealing possible
remedies.
