Jose Reyes Killed in Car Accident on North Cooper Street in Arlington, Texas
According to the Star-Telegram, a man died from an automobile accident
in Arlington, Texas. The wreck occurred around 8:30 p.m. Tuesday,
November 29 when 23-year-old Jose Reyes was driving along North Cooper
Street and tried to make a left turn onto Road to Six Flags when his
vehicle was struck by an Acura. Reyes was taken to John Peter Smith
Hospital in Fort Worth where he later passed away.
Commentary Little
information is provided regarding how the accident occurred. In matters
like this when causation is difficult to ascertain, a third party
investigation should be used to determine liability and extol any
potential strategies that may exist towards a civil remedy. This is
necessary because a plaintiff is tasked with providing evidence if they
are to be compensated in an accident. Speaking more to this,
when a fatality occurs from an accident, the remedy available is a
wrongful death claim, if certain criteria are met. The first element is a
party must be identified as liable. The next, and probably most
important piece of a claim, is that the liable party must be identified
as negligent. This is a determination made with evidence from the scene,
geared at the party's actions prior to the accident. Their actions are
compared with what a reasonable person would expect and if they are
believed to have fallen below this level, negligence is typically
determined. From there, a claim needs survivors who are eligible under
Texas law to file on behalf of the victim and these survivors must be
able to prove an actual loss of finances because of the accident.
