Pedestrian Joe King Killed by Hit-and-Run Driver in Dallas, Texas
According to Fox 4, a man was killed crossing Cedar Springs Road in
Dallas, Texas. The accident occurred Saturday night, November 26 when
62-year-old Joe King was crossing the street on the crosswalk, when a
dark-colored SUV struck him and drove away. Dallas police report many
witnesses saw the accident and they believe surveillance cameras caught
the event. Their investigation continues.
Commentary Hit-and-run accidents are a particularly frustrating part of
my job because not only is the potential for evidence tampering
greater, but the family of the victim cannot receive closure until the
suspect is apprehended. Also, it takes a bit more digging to find out
what really happened that night, as time has passed from the accident.
In my experience over the years, many who flee the scene of an accident
are hiding something beyond the pedestrian collision, like possible
intoxication, warrants, or some type of possession. The contingencies in
a hit-and-run accident are all over the spectrum, making a third party
investigation necessary. Beyond the other contingencies
mentioned, the investigation would check the relative position of the
man walking across the street, with the vehicle in question, making sure
one had right-of-way over the other. Unfortunately, failing to stop and
render aid does not automatically mean the driver assumes all fault
from the accident. Liability is a fluid thing, which makes the need for
an investigation all the more necessary, as just like the plaintiff has
the burden of proving evidence, defense attorneys employ the opposite
approach to mitigate liability for their client.
