James Harris and Jake James Killed in Wrong-Way Car Accident near Azle, Texas
According to CBS DFW, two men were killed in a wrong-way car accident near Azle, Texas. The wreck occurred late Wednesday night, November 23 when the Tarrant County Sheriff's Office believes 72-year-old Jake James swerved into oncoming traffic on Jacksboro Highway and struck the vehicle of 17-year-old James Harris head-on. Both cars ignited at the scene, killing both drivers. The Tarrant County Sheriff's Office continues to investigate the accident.
Commentary This is an incredibly tragic accident. My condolences go out to both families involved. Though alcohol has been suggested as a possible factor in the accident, that has not been established and would be purely speculation at this point. Since there are no eye witnesses to the accident (according to the news feed), a third party investigation should be used to recreate the accident. The investigation is crucial in determining civil remedies available because one of the key determinations could form the basis of a wrongful death claim. To have standing in such a claim, a few key elements must be met. First, a party must be identified as liable in the accident. Next, their actions prior to the accident must be determined negligent. Meeting this standard requires finding that the liable party's actions fell below what a reasonable person would expect prior to the accident. From there, a claim must have survivors that are eligible under Texas law to bring a claim on the victim's behalf, and they must be able to show a court that they incurred some type of financial loss as a result of the accident.
