Jeffery Hogan Killed Following Wrong-Way Driver on Interstate 35 in Fort Worth, Texas
According to the Star-Telegram, one person was killed in an accident avoiding a wrong-way driver on Interstate 35 in Fort Worth, Texas. The wreck occurred late Saturday evening, November 26 when police believe Brittany Burton drove the wrong way down the interstate. Avoiding the wrong-way vehicle, a Civic and another vehicle swerved onto the inside shoulder and became involved in a minor accident. While assessing the damage, a Ford van struck both vehicles, killing one driver. Several miles away, the Fort Worth Police stopped the wrong-way driver and arrested her on suspicion of intoxication manslaughter and endangering a child.

Commentary My thoughts are with the victim and their family in this accident. Some of the news feeds note the driver of the van that struck the two disabled vehicles encountered the wrong-way driver on the interstate as well. Liability is a designation that can spread to multiple parties, meaning the wrong-way driver or the driver of the van could share fault. Before this can be defined, an independent investigation should be used to recreate the accident and determine possible remedies from the accident. The investigation would determine if the wrong-way driver directly influenced the van striking the two vehicles or if the driver of the van was negligent in swerving into the inside shoulder of the roadway. Like I mentioned before, liability is not an all-or-nothing proposition. In other words, more than likely a single party will not be found fully liable in an accident, and that could be the case here as well. A proper liability determination is necessary in a civil course of action, in this accident a wrongful death claim, as a party must be identified as liable and negligent to be pursued.
