One Man Killed, Another Injured in Disabled Car Accident in Houston, Texas
According to the Houston Chronicle, a man was killed and another injured
in a disabled vehicle wreck along U.S. 290 in Houston, Texas. The
accident occurred around 6:40 p.m. Tuesday, November 22 when Houston
police believe the driver of a Nissan 240 SX pulled off the road when
his vehicle became disabled. Another motorist stopped to help the man
when a Chevy Suburban changed lanes on the highway and struck one of the
stopped cars. The driver of the disabled car was killed at the scene,
while the motorist who stopped to help was taken to a local hospital
where his condition is unknown. The names of the victims have not been
announced, pending investigation.
Commentary We
recently litigated a fatal car accident involving a disabled vehicle and
a driver who swerved onto the shoulder. In that particular case, it was
found that the driver was heavily distracted prior to the accident, and
this inattentiveness led to the victim's fatal injuries. This was only
devised, however, by examining all parties involved in the accident and
understanding their relative position on the roadway. Factors like these
prove the worth of conducting an independent investigation, beyond that
of the police reports. The investigation aids in making a
liability judgement, which helps to establish civil strategies for
victims of an accident. In a personal injury or wrongful death, the
plaintiff is tasked with proving the other party, the defendant, caused
or played a measurable role in the accident. This is the basis of
personal injury law, as a breach of duty must occur to have standing for
a claim against a party. In other words, a plaintiff is tasked with
proving the other party owed them some level of care prior to the
accident, in this matter, safe operation around a disabled vehicle. The
