Jose Ramirez, Juan Flores-Garcia Killed in Auto Accident, 2 Others Hurt in San Antonio, Texas
According to the San Antonio Express, two men were killed and two others injured in an automobile accident in San Antonio, Texas. The collision occurred around 12:30 p.m. Sunday, November 20 when San Antonio police believe a small car clipped the SUV of 34-year-old Jose Ramirez, causing the vehicle to roll several times. Ramirez and his backseat passenger were killed in the accident, while two others in the vehicle were seriously injured. The front seat passenger in the SUV was taken to University Hospital, while another passenger was taken to San Antonio Military Medical Center, both with what are thought to be non-life threatening injuries.
Update: Juan Flores-Garcia has been identified as the other decedent in the accident.
Commentary Some may not realize that while no criminal charges have been filed, an accident's cause could have standing in a civil claim. When an accident is suspected to have occurred because of the actions of another party, a detailed investigation is needed to concrete this liability. To have standing in a wrongful death lawsuit, a few elements must be met. First, a party must be identified as liable in the accident. Then, their actions or inaction prior to the collision must be ruled negligent. This is a determination made by a party allowing their standard of care in a situation (in this matter their safe operation of a motor vehicle) to drop below what a normal person would expect. Most would expect their vehicle not to be clipped on the roadway, so this could possibly meet this standard. From there, a claim must have survivors who are eligible under Texas laws to file a claim on the victim's behalf, and they must be able to show a financial loss as a result of the incident.
