Quilon Cotton Killed in Single-Vehicle Wrong-Way Accident in Dallas, Texas
According to the Dallas Morning News, a man was killed in a one-car
accident in Dallas, Texas. The accident occurred around 3:30 a.m.
Saturday, November 19 when Dallas police believe 35-year-old Quilon
Cotton drove the wrong way onto a Central Expressway exit ramp. His
vehicle crossed the exit's curb, fell on to a grass median, and struck a
concrete pillar. Cotton was taken to Baylor Medical Center at Dallas
where he was later pronounced dead.
Commentary Having
handled many single-car accidents in the past, I know what conclusions
many will make. However, before someone can arbitrarily claim that the
man was intoxicated or maybe speeding, a person should look at the
overall situation of the accident in question. Furthermore, to
concretely determine liability, a third party investigation should be
initiated and hopefully develop a civil strategy moving
forward. The first thing the investigation should address is
the signage and layout of the Central Expressway exit ramp. That
particular area of Dallas, near downtown, is tricky even for seasoned
drivers. In other words, did the man have proper warning via "Wrong Way"
signage before entering the exit ramp? Was the sign clearly visible and
distinctive among the other metallic structures around Central? The
question becomes, was the driver given a proper warning before going the
wrong way on the exit ramp? The answer is either explicitly 'yes', or
their could be liability elsewhere. It is possible the city was
haphazard in placing signage before and along the ramp, and a driver
unfamiliar with the territory got turned around from a lack of warning.
This is not beyond the realm of reason at all, and shows why jumping to
conclusions following an accident's report could be flat wrong.
