Mariano Elias Landaverde Killed in Head-On Collision in Montgomery, Texas
According to the Montgomery County Police Reporter, one person was
killed and another injured in a head-on collision in Southeast
Montgomery, Texas. The wreck occurred around 4:30 p.m. Tuesday, November
15 when witnesses believe 19-year-old Zack James Stevens was operating
his Saturn Sky at a high rate of speed. Witnesses state he went to pass
vehicles on the shoulder of the highway when he struck a guardrail and
crossed into the oncoming traffic of FM 1485. The Saturn then struck the
vehicle of 40-year-old Mariano Elias Landaverde head-on, killing them
at the scene. Stevens was taken to Hermann Hospital in Houston in
critical condition.
Commentary When a fatal automobile
accident occurs from the alleged actions of another party, a third party
investigation is needed to confirm liability and develop a strategy
regarding potential civil remedies. Most realize that a civil action may
exist when an injury occurs from another party, but may not be aware of
the details of that specific action, a wrongful death suit.
To have standing in a wrongful death claim, a few elements
must exist. First, a party must be identified as liable in the accident.
Liability however, is not the only element needed. A party's actions or
inaction prior to the accident must be ruled negligent. In other words,
their behavior before the accident must be contrary to what a
reasonable would expect. Driving at a high rate of speed and on the
shoulder to pass other vehicles could prove to be contrary to this
expectation. Beyond this, a victim must have survivors who are eligible
under Texas law to file a lawsuit on their behalf, and the survivors
must be able to show in a court of law tangible economic loss from the
accident. A successful wrongful death claim can provide
survivors with damages like pain and suffering, funeral costs, and loss
of financial support the victim provided before the wreck.
