One Man Dead, Woman Injured in Head-On Collision in Cleveland, Texas
According to the Montgomery County Police Reporter, a man was killed and
a woman critically injured in a head-on collision in Cleveland, Texas.
The accident happened around 6:50 p.m. Monday, November 14 when police
believe the woman, who was driving a Toyota Tacoma crossed the center
line of FM 2025 and struck the Ford Ranger the man was driving. He was
taken to Cleveland Hospital where he was pronounced dead. The female
driver was taken by Life Flight to Houston, in critical condition. Both
drivers are currently unidentified. The Texas Department of Public
Safety and Cleveland Police continue to investigate the accident.
Commentary When a
catastrophic accident occurs, questions are rarely answered by initial
examinations. If eyewitnesses are not present to the accident,
recreation becomes even more difficult. Because of these issues, an
independent investigation should be used to supplement the police
reports. To have standing in a civil claim, a party must have concrete
evidence against another party, as a plaintiff is tasked with the burden
of proof. For a wrongful death claim to have merit, beyond
simply having a liable party, that party must be found to be negligent
in the accident. Negligence stems from a party allowing their standard
of care (in this matter their safe operation of an automobile) to fall
below what a normal person would expect. So in other words, if the
reports are accurate, driving on the correct side of the road is
reasonable. Following this, a victim must have survivors who qualify
under Texas law to file a claim on their behalf. Lastly, they must be
able to show a financial loss resulting from the accident. A
successful claim can provide survivors with damages like pain and
suffering, medical bills incurred before the victim's death, funeral
costs, and loss of consortium to name a few.
