Betsy Salazar Killed, 3 Others Hurt in Accident with Alleged Drunk Driver in Palestine, Texas
According to KLTV, a woman was killed and 3 others were injured in a
collision with a suspected drunk driver near Palestine in Elkhart,
Texas. The accident occurred around 1:30 a.m. Saturday, November 12 when
police believe Erik Green crossed over the center line of Highway 287
and struck an SUV. Killed in the accident was 40-year-old Betsy Salazar,
while 24-year-old Leubin Garcia, 22-year-old Anna Pecina, and
21-year-old Marysol Pecina were all injured. Green has been charged with
intoxication manslaughter with vehicle.
Commentary Texas
holds the dubious distinction of consistently ranking in the bottom 10%
of accidents caused by drunk driving. It is quite obvious to most that a
change is needed, but the debate bifurcates along where this change
should be made. At my firm we take a hardline approach to one of the
causes of drunk driving accidents. Before going forward, the
allegations of drunk driving would need to be confirmed by local
authorities. If they are concreted, an independent examination of the
accident and the surrounding details should be viewed to determine if a
civil strategy exists for victims or their survivors. Most realize that
if a person played a role in another party's death, that person could
potentially face civil suits. Others may not realize that often times
another party is liable in an accident, a party that may not be
apparent, or present, at the scene. Again, police would need
to concrete the drunk driving link, but if that were found to be true,
the investigation should trace the driver's steps before the wreck, and
note whether a bar or restaurant was visited before the accident. Texas
dram shop laws hold a bar partially liable if they were found to serve a
guest past the point of being "obviously intoxicated." Taking someone
to this level of intoxication is not only dangerous to the patron
themselves, but to others around them, especially on the roadway. The
laws, however, do not fault a bar entirely for the accident, as at the
end of the day they were not driving. But the collection of laws and
caselaw do strike bars or restaurants that negligently over-serve where
it may matter most, financially.
