Miguel Alonzo III Killed in Hit-and-Run Accident in San Antonio, Texas
According to My San Antonio, a man was killed in a hit-and-run incident in San Antonio, Texas. The accident occurred around 2:15 a.m. Sunday, November 13 when 24-year-old Miguel Alonzo III witnessed an SUV strike a friend of his in a parking lot. After attempting to follow the SUV, the driver turned the vehicle around and ran over Alonzo, apparently accelerating after impact. Alonzo was taken to Unversity Hospital where he later passed away. San Antonio police are investigating the accident.
Commentary In most situations, hit-and-runs are framed from an accident's perspective. It would appear, however, that this was no accident, and rather the intention of a driver to physically harm someone. Once the driver is found, a third party investigation should be used to shore up liability and develop a civil strategy moving forward. The most obvious remedy from a hit-and-run collision resulting in death is a wrongful death claim. But, it should be noted that just the event itself does not automatically warrant this type of claim. To be successful, a few key elements must be met to have standing in a civil action. First, a party must be identified as liable in the incident. Their actions must then be linked to some form of negligence which resulted in the collision. Negligence is typically defined as allowing one's actions to fall below what a reasonable person would expect prior to the accident, in this matter a driver's vehicle operation. Finally, a claim needs survivors of the victim, who are eligible under Texas state law to file a lawsuit, and they must be able to show an actual loss of economics because of the victim's death.
