Pedestrian Dustin O'Dell Killed by A-Train in Carrollton, Texas
According to the Dallas Morning News, a person was struck and killed by an A-Train in Carrollton, Texas. The accident occurred Friday morning, November 11 when Denton County Transportation Authorities believe the person was walking near the tracks. No passengers on-board the train were injured. The DCTA is investigating the accident.
Update: The victim has been identified as 23-year-old Dustin O'Dell.
Commentary Thankfully, a train wreck is a foreign entity to most of us. For a victim or their survivors to know where they stand regarding a potential remedy, an independent investigation must be used to extol the relevant details from the scene. Contrary to what most may expect from an accident like this, there are quite a few possible liable parties. Certainly the position of the pedestrian, relative to the tracks, could fault them. However, what if the train's conductor did not use their horn before the accident? This could be a liable action as well. Similarly, just like car accidents, train wrecks can occur from a failure to maintenance the train. Perhaps the conductor tried to stop the train, but a worn braking system made this impossible. Such a scenario could hold an owner of the train at-fault in the accident. Obviously, with the few details present about the incident, this is speculation. But, it would be an oversight to view this accident as only between the train and pedestrian. In actuality, most accidents involve several parties, some of whom may not be present at the actual scene.
