One Person Dead, Two Injured in a Single-Vehicle Car Accident in Austin, Texas
According to KXAN, one person was killed and two others injured in a
single-vehicle accident in Austin, Texas. The wreck occurred Thursday
afternoon, November 10 when Austin police believe the driver of the
vehicle struck a tree on Lakeline Boulevard. Two victims had to be cut
from the vehicle and taken to a local hospital, while one was pronounced
dead at the scene. Police believe speed may have been a factor in the
crash.
Commentary Though
very few details have emerged regarding the accident, I can certainly
say this is a tragedy. While the initial police reports note a possible
speeding driver, that link would need to be concretely established. A
third party investigation should be used to determine liable parties and
develop a civil strategy regarding possible remedies. To have
standing in a civil claim, namely a wrongful death action, a few
aspects must be present. First, a party must be identified as liable in
the accident. From there, the liable party's actions or inaction must be
deemed negligent, and beyond the scope of how a reasonable person would
expect that person to act, with regard to the wreck. Finally, a claim
needs survivors of the victim(s) who are eligible under state law to
file on the victim's behalf, and they must be able to show a tangible
economic loss from the accident. Without any of these elements,
typically a claim does not have standing.
