Trevor Reinhold Strong, Derek Jason Walker Killed in Hit-and-Run Accident in Donna, Texas
According to the Houston Chronicle, two men were killed and another injured on their bicycles by a hit-and-run accident in Donna, Texas. The collision occurred around 7 p.m. Tuesday, November 8 when 21-year-old Trevor Reinhold Strong and 20-year-old Derek Jason Walker were killed by a hit-and-run driver. 19-year-old Zachary Todd Harris was also struck, and later treated and released. The driver was later found and arrested. Commentary My thoughts are with the victims and their families following this accident. Luckily the driver was caught shortly after the incident, as this will aid in speeding along the police investigation. In addition to the police reports, a third party examination of the wreck should take place, which will provide a strategy regarding potential civil remedies available. The investigation would pair the driver's actions in the roadway, with the bicyclists' position, to determine who is at fault in the collision. For the foundation of a wrongful death claim, a liable party must be determined from the accident. Liability however, is not enough, as negligence must then be proven. This standard goes back to the third party examination, as facts dictate the determination. Beyond this, a claim must have survivors who are eligible under Texas law to file a claim, and they must be able to show an economic loss from the accident. Without any of these elements, typically there can be no claim. If successful, a claim of this nature can provide for damages like funeral costs, medical bills the victim suffered prior to the accident, or loss of consortium.
