According to WFAA, one person was killed and three others injured in a
head-on collision in Melissa, Texas. The accident occurred Tuesday,
November 8 when the vehicles collided near SH 121 and SH 160. Three
people were taken to a local hospital, while one person was killed in
the accident. No further details, including the names of the victims,
have been released pending investigation.
Commentary Though
very few details have been released, I can say with certainty that this
is a tragic situation. Because many relevant factors may not be apparent
at the incident, a third party investigation is needed to reveal causal
links to the accident. The findings of the investigation would help to
develop a strategy moving forward regarding any potential civil remedies
from the collision. To have standing in wrongful death claim,
a few elements must be met. A liable party must be identified from the
accident. Beyond that, the liable party's negligent participation must
have contributed to the accident. From there, a claim must have
survivors who are eligible under Texas state law to file on behalf of
the victim, and they must be able to show a tangible economic loss from
the accident.
