Katherine Giddens Killed, Max Copeland Injured in Wrong-Way Collision in Vidor, TX
Local news reports indicate a woman was killed and another man injured in an automobile accident in Vidor, Texas. The wreck occurred around 6 a.m. Tuesday, November 8 when Vidor police believe a driver of a Dodge truck crossed into oncoming traffic and struck a Kia, mostly on the passenger side. The passenger of the Kia, 48-year-old Katherine Giddens was killed in the collision, while Max Carol Copeland, the alleged driver of the Dodge was hospitalized. Vidor police continue the investigation into the incident.
Commentary Often when our firm handles a wrongful death claim as a result of a fatal car accident, the actual defendant in the claim is of no bother to the proceeding. The real threat to a victim or their survivors' case is actually usually from an insurance adjuster handling the compensation aspect of the accident. Unfortunately in my experience, one of the main ways adjusters interfere with properly compensating victims is an upfront attempt at settling the claim. While masked in the veil of a good gesture, this settlement offer is almost always incredibly below what an accident is actually worth. Furthermore, the deal comes with the caveat of precluding any future attempts at increasing the settlement, as this is the final offer that will be made. It's important to remember at the end of the day that adjusters work for a business, not a victim. So essentially, it is in their best interest to squeeze pennies out of a settlement, and certainly in the insurance company's best interest. While maybe fiduciary, this relationship endangers a victim's chances at a fair offer for their accident.
