Floyd Jones Killed in Pedestrian Accident in south Fort Worth, Texas
According to the Star-Telegram, a man was struck and killed by a vehicle
in south Fort Worth, Texas. The collision occurred around 6:30 p.m.
Monday, November 7 when 60-year-old Floyd Jones was hit on Garden Acres
Drive, near his home. A motorist told police she slowed for a speed bump
when she heard something hit her passenger side mirror. Fort Worth
police continue to investigate the accident.
Commentary Several
of the reports about this incident note no criminal charges are pending
against the driver. Many seem to pair civil and criminal law, and lump
them together in an all-or-nothing scenario. This is actually not true.
Both sides of the law are mutually exclusive, meaning they do not
require the others presence for standing. To have standing in a
civil claim and subsequent wrongful death suit, a liable party must be
identified. From there, a victim's death must have been the result of
that liable party's negligent actions or inaction. Negligence is a
standard of law that states a defendant allowed their level of care to
fall below what a reasonable person would expect in the situation. Now,
to what level this care fell is a matter of details, and should be
examined by an independent investigation. For example, if a defendant
was speeding in a pedestrian area, that would probably lower their level
of care (though it should be noted the article states the driver slowed
down). The point is, liability is a fluid entity of law that, just like
the above mentioned criminal and civil law proceedings, is not
all-or-nothing. Because of this fact-specific situation, the necessity
of a proper investigation is even more apparent.
