Pedestrian Adam Conrad Grote Killed in Hit-and-Run Accident on I-35S in Austin, Texas
Local news reports indicate a man was killed when he was struck by another vehicle in Austin, Texas. The incident happened around 3 a.m. Sunday, November 6 when the unidentified man was struck by a hit-and-run driver while walking on the shoulder of I-35S. Witnesses reported following the driver from downtown and seeing the vehicle swerve into the shoulder and hit the unidentified victim.
Update: The victim has been identified as 22-year-old Adam Conrad Grote.
Commentary It is rare that a hit-and-run accident this early in the morning produces so many witnesses, but thankfully many saw the wreck. Once the errant driver is caught, an investigation should work in collaboration with the police reports to determine liability and develop a strategy regarding civil remedies moving forward. If the reports are accurate and the driver of the vehicle swerved into the shoulder, striking the man, they may face fault from the accident. With this fault, there may be standing for a wrongful death claim, as a person's negligence is key in having a cause for action. To be found negligent, a person's standard of care (in this matter, relevant to their level of safety) must have fallen below what a reasonable person would expect at the time of the accident. As you can probably see, this is very dependent on the specifics of the incident and reveal why a third party investigation is needed.
