29 People Now Dead From Listeria Outbreak from Cantaloupe
According to the Associated Press, 29 people have died from the recent Listeria outbreak, the most recent victim from Colorado. In total, 139 people have either become sick from the tainted cantaloupe or have died. The Centers for Disease Control and Prevention note the outbreak has spread to 28 states.
Commentary I've blogged a few times on the Listeria outbreak, but the effects of the tainted cantaloupe keep manifesting themselves. The FDA pulled the Jensen Farms cantaloupe September 14th, but the problem with Listeria is that symptoms can take up to two months to appear. Normally, injuries from food products do not usually warrant the costs associated with litigation. Stomach aches may keep someone out of work for a day or two, but again, probably do not reach the threshold of good economic sense for a claim. However, when a fatality occurs from consuming a tainted product, the economics change immensely. An independent investigation should be used to shore up the link between the product in question and the resulting death.
