Commentary Unfortunately, my firm has litigated several cases involving a driver who did not use extra caution when operating through an accident scene. Because liability in a matter like this, which involves multiple parties and vehicles, is a tricky thing to unravel, a detailed independent investigation is needed in conjunction with the police reports. This will allow a strategy regarding any potential civil remedies to develop. Regarding those strategies, the most apparent outcome from the accident is probably a wrongful death motion. To have standing for a claim like this, a few key elements must be met. First, and probably most important to the claim, a foundation of negligence must be established. The suit requires a liable party to be identified as negligent via their actions or inaction that led to the accident. This is essentially an argument based on reasonableness, as negligence in this matter relates to whether or not a reasonable person has an expectation of safety following a minor collision. Obviously this is dependent on issues like where the wreck occurred, where the victims were in the street following the wreck, etc., but I believe most would agree there's a heightened need for caution and attention around a crash scene. From a negligence establishment, a claim only needs survivors who are eligible under Texas law to file on the victim's behalf, and they must be able to show an actual economic loss from the accident. Successful wrongful death claims can provide damages like medical bills the victim may have incurred prior to their death, funeral arrangement costs, or loss of consortium.
