Charles Dubose Killed in Single-Vehicle Accident in Houston, Texas
According to the Houston Chronicle, a man was killed in a single-vehicle accident in north Houston, Texas. The wreck occurred around 6:40 a.m. Tuesday, November 2 when police believe Charles Dubose lost control of his 1992 Jeep Cherokee. The vehicle crossed through oncoming traffic, through a concrete drainage ditch, rolled onto its side and struck a utility pole. Harris County deputies continue to investigate the crash.
Commentary This accident strikes me as suspicious for a number of reasons. A single-vehicle wreck requires a meticulous investigation into its cause, as this is typically not evident from the scene. In the past, DaimlerChrysler Corporation was a listed defendant in a very large class action lawsuit, alleging their Cherokees made between 1999 and 2004 hold faulty or defective front brake discs or rotors. This defect was said to produce uneven thickness in the discs, and in some cases, lead to a braking failure. Certainly the report does not cite anything mechanically-related, but in reality, they never do. What is needed, then, is a detailed inspection on the vehicle to determine what led to this accident. Many view an incident like this and automatically assume driver error. However, the last I checked, the mentioned class-action reached over one million vehicles, indicating there really could be a mechanical issue here. A claim against a manufacturer is not easy though, and requires a thorough analysis that can link the accident to a particular defect. Defense attorneys are very good at disputing the owner's maintenance of the vehicle, or some other negating issue, to remove fault from their client's product.
