Carmen Trevino Killed in Accident with Driver who Ran Red Light in Pecan Grove, Texas
According to the Houston Chronicle, a woman was killed in a collision
with an SUV in Pecan Grove, Texas. The wreck occurred around 9:05 a.m.
Saturday, October 29 when Texas Department of Public Safety officials
believe a Nissan SUV ran a red light and struck a GMC vehicle. The
accident caused the GMC to spin and rollover 4 times, ejecting a
passenger. 46-year-old Carmen Trevino was pronounced dead at the scene. 4
other passengers, all female, were taken to local hospitals in stable
condition.
Commentary When a
fatality occurs from the alleged actions of another party, the police
reports prove to be invaluable in determining liability. With this
information, a third party investigation should be conducted to
determine possible routes for civil remedies. To have standing
against another party, the plaintiff has the burden of proof in showing
that (in this accident) the driver was liable. Police reports alone
will not win a case in court, but rather act as a supplement to other
evidence. For a claim to proceed, a party must be identified as liable
in a matter. Beyond that, the liable party's actions or inaction must
have been negligently involved in the accident itself. Negligence is
defined by allowing one's standard of care (in this matter their safe
operation of a motor vehicle) to fall below what a reasonable person
would expect. Typically, failing to adhere to posted traffic signs could
reach this legal status. What's left of a claim are eligible survivors
(under the state's law) that can prove a tangible loss from the
accident. Any scenario that is missing one of these elements typically
cannot move forward.
