Commentary Operating a vehicle near a motorcycle requires extra regard
to safety, as the potential for catastrophic injury is increased, if an
accident were to occur. Following the conclusion of the police report,
and after an at-fault determination has been made, a private
investigation should be used to obtain a grasp of potential remedies
available to survivors of the victim. With corroboration
between the police reports and investigation, there may be standing for a
wrongful death claim against the driver of the SUV. The doubling up of a
liability determination is crucial, as a victim (the plaintiff) has the
burden of proof in a civil claim. Furthermore, the at-fault designation
is probably the most vital to a wrongful death motion, as this forms
the foundation of the claim. If a liable party is found to have
negligently caused the accident, meaning their actions or inaction fell
below what a reasonable person would expect in regards to safety, there
may be standing for a claim. Again, this is heavily dependent on the
reports and investigations, and prove the worth of either. From there, a
claim only further needs survivors of the victim, who are eligible
under state law to file on the victim's behalf, and they must be able to
show a tangible economic loss. A successful wrongful death
claim can provide for damages like funeral arrangements, loss of support
the victim provided before the accident, and loss of consortium.
